For the first time, Idaho’s Non-Economic Damages Cap exceeds $500,000

Every July 1, the non-economic damages cap is adjusted to account for inflation and the average annual wage as calculated by the Idaho Industrial Commission. In 2025, we see a modest increase versus the trend over the previous three years. The 2025 increase is 3.77%, representing an increase of $18,500.59.  Though a modest increase, for the first time, the cap exceeds $500,000. The non-economic damages cap now sits at $509,013.28. 

From 2022 to 2024, the increase hovered around 7%. It previously took 12 years to increase by the same dollar amount achieved in the past 3 years.  Please click here to view the non-economic damages caps for 2006 – 2025.

Idaho Statute Section 6-1603 is silent on the date/event (time of injury, time of complaint, time of verdict) that attaches to the cap.
